§. Heads under which statements are to be received or extracted
from an Applicant.
Art. 1. On the appearance of an applicant for
the first time at before the Judgment Seat, the Judge receives
extracts or dos what depends upon him towards extracting
his testimony, in relation to the particulars questions following.
1. His names, age and then present abode and address
present, and future during the suit.
2. Extra Judicial service demanded by him
3. Correspondent Judicial service requisite. This the Judge inferrs from
the nature of the extra-judicial service.
4. Person or persons at whose charge the extra-judicial
service is demanded: whether known or unknown to him.
5. If known or this as If known, then In so far as known, their several
descriptions under the first head.
6. If unknown, such description as can be given of
them.
7. Collative state of things or event or events, on which on the ground of his demand
of the service in question in the character of collative facts, his may be capable of
being grounded.
8. Collative ordinance or ordinances on which, on
the ground of law his demand may be capable of
being grounded. Under this head the information indication necessary
ought regularly naturally to be furnished by the applicant
himself: but if, through simplicity, he appears
unable to furnish it, the Judge, if so it be that the in so far as the information
extracted serves statement of the facts, supposing the statement given of them
appears sufficiently correct, pronounces and by appropriate information causes to be entered
the ordinance any such ordinance or ordinances
as with relation to the demand, present themselves
to his mind provisionally in the character of
collative ordinances.
