I. Offences – to what applicable.
All offences in
so far as intention is
discoverable: viz. by conjective,
information
by conspiration, threats,
preparation or attempts.

II. Preventive remedies –
what employable.
1. Bondsmen finding.
2. Presence banishment.
3. Perhaps in some dangerous
cases, temporary
imprisonment.
4. Inquirendum whether,
when disabled as
to consummation per
se
, consummation
may not be practicable
by human instruments,
or other co-delinquents.

III. Measure of the demand
for prevention
and quantity of suffering
employable on that
occasion.
1. Magnitude of the evil
apprehended.
2. Magnitude of the
danger, i.e. probability
of consummation.

IV. English Law –
scantiness of it's provision
for the purposes
of justice prevention
1. Scantiness of the portion
operated upon in
the field of delinquency.
2. Inadequacy and inappositeness
of the arrangements
employed for prevention.
3. Constant junction of
bondsmen-finding
and consent to self
seated punishment –
it's incongruity.
4. To eventually self-seated
punishment, delinquent
might better be
subjected by warning
from the Judge, without
forced consent.

The eventual subjection
to the vicarious punishment
might then be
regulated by the pecuniary
circumstances
of the bondsmen, self-seated
by those of the delinquent.

One source of demand
for preventve
remedies is constituted
by the remedies needed
for continuous offences:

or a ward, out of the
custody and presence
of the power0holder,
viz. the husband, father,
or guardian,
comes under this head.

So, a soldier or subordinate
military
functionary, out of
the command of his
superordinate.

civil functionaries.
