<p>Of this doctrine of aggravations, the principal<lb/>
 
use in practice seems to be the giving to the punishment,<lb/>
in cases of extraordinary mischief – the<lb/>
quality of characteristicalness for the purpose of exemplarity:<lb/>
the effect aimed at is the making an impression<lb/>
upon the public opinion tribunal that the influence<lb/>
of that authority may with the greater force<lb/>
be applied to the repression of the offence.</p>
<p>Happily these cases in which the evil receives<lb/>
any such prodigious augmentation, are comparatively<lb/>
rare.  For, so far as they have place,<lb/>
then comes the dilemma, appoint for the greater<lb/>
evil no greater punishment than for the less,<lb/>
here, in respect of everything that is above the<lb/>
less, you grant a license for the commission of the<lb/>
offence:  augment the punishment in proportion<lb/>
to the augmentation of evil on the part of the offence,<lb/>
before you have proceeded to any considerable<lb/>
length in this track, you have screwed<lb/>
up the punishment to such a hight that public<lb/>
humanity can not endure the idea of it,<lb/>
parties injured sink from prosecution, witnesses<lb/>
prefer mendacity to what in their eyes is cruelty.<lb/>
Be the sort of offence what it may, number<lb/>
of instances, aggravated and unaggravated cases together,<lb/>
in which it has been committed in the<lb/>
course of a year, so and so, what has been the<lb/>
number of the cases accompanied with the several<lb/>
