Law Amendment.
Propositions
Ch. Procedure
§§ Conclusion or All-comprehensiveness
According to this
arrangement the
matter of existing book
of practice classed in the
appendix.
The giving facility to conception or guidance to false proceedings
no course more effectual does the nature of the case indicate of
than the making reference to the several books of procedure in which
by enumeration of the topics touched hinted upon indication of is afforded
of the several correspondent portions of matter ranged under those same heads
In the Appendix to this paper will accordingly be found the
principal heads of matter exhibited b in and by the Table appended to
the latest or most apparently instructive books of practice having
for their subjects the course of procedure pursued in and by
the respective Judicatures.
Sign for distinguishing
superfluous matter
By an o indication will be given of the several portions
of matter which being regarded as plenty superfluous are
proposed to be extinguished without the addition of any portion of
matter respectively designed for a substitution or succedaneum
to the matter so proposed to be discarded
for matter requiring
provision different
from that in existing
System
By an o crossed with a + those portions by which
provision is made for an exigence, for which else by the several ends
of justice requires that provision should be made, but provision in
a shape more or less different from that in which under the existing system
it is made.
To render the choices and thus made consistent
with strict accuracy, and at the same time to make proof apparent that it is
so would require dissertation upon dissertation, and thereby time and
space much beyond what for the present purpose can be needed, or on the
present occasion be spared allotted The part the enquiry of those whom it
may concern — to and not to it the object and
the only object to which the present endeavour could be directed.
When the enquiry in question is one of the number of them which in regard to which
provision having been made by the existing system is stated as one for
which by the end of justice provision requires to be made and
under the here proposed system has accordingly been made, whatever
is then given to those whom it may concern, to enforce the two
systems and the provision made in relation to those heads: by the one
with the provision made in relation to those same heads by the other.
