Considerations for
determining days &
hours appointed

For their attendance respectively what shall be the
days and hours appointed?

Answer. Considerations by which the appointment will have
to be determined, these

1 Earliest unoccupied
days & hour

1. Earliest Days and hour on which the Judicatory, all time being unoccupied,
affords a prospect of being free at liberty to receive them

2 Days & hours which
will most advance the
suit

2. Those days and hours, on for the appointment of which respectively, by the order assigned
to them the par it appears probable from the order so assigned to them that the p suit in its progress
will receive most advancement. If neither The best that can
happen is — that they should appear, all of them, on one and the
same day but if by so it happens that upon the first earliest open day
some are able to attend while others are not in general there will
be no reason why the examination should be delayed by the non
attendance of another, exception provided that neither non litigant
nor litigant witness be thereby left unexposed to made exempt from counter interrogation
the check applied by counterrogation

Convenience of all parties
committed to the utmost

On the plan provided for on each individual occasion to the
utmost will be the convenience of all parties concerned: in the first
place the convenience of the Judge, that is to say of the several parties
concerned in other suits in the several capacities of plaintiff pursuer
defendants and non litigant witnesses. 2. in the next place the
several persons concerned in that same individual cause in these
several coparties in that same individual suit.
