If, in every case, in which it is produced,
by the act of man, mental vexation were
deemed wrongful, and, as such, made punishable
one consequence among others would be that punishment would thus be made to
attach upon all competitors, and thus upon
all human beings. Sufficiently evident, in
this view is the necessity of limitation.

Limitation to a certain extent would
be applied by the application of the efficient
causes of justification to mental, as under
the last head, to corporal vexation.

Another demand for limitation
will be seen produced by the several cases,
in which the offence receives from some specifick
aggravation modificative and in general generally speaking aggravative
circumstance, a distinct denomination
– witness the case of menacement.
Still, however, much demand remains for ulterior limitation.
