21. C Of Semi-public Offences in General.

in respect of the manner in which they affect the person whom they regard stand upon a footing which is in great measure opposite to that on which
those of the preceding division appear to stand. Offences against a Neighbourhood,
we observed, could scarcely affect men in any other way than in point of
person or of property: in point of reputation or condition men could hardly
be affected by them. But among Offences whereby a factitious Class
of persons may be affected, are hardly to be found any which can
directly affect men in their persons.

Nor any peculiar relation to property. To this division however as well as to the former may belong
Offences against property: for whatever article is capable of belonging to
a single individual, may belong jointly to a factitious class of persons;
and is exposed to the same attacks in this case as in the former.

But they may to reputation and professional condition. But it is in point of reputation and condition that a factitious
class of persons is particularly vulnerable. It can scarcely happen
that all the members of a civil corporation, or of a religious sect,
or that all the subjects or natives(d) of a particular state, or of a particular

Note.

[(a) Natives.] The class composed of all the natives of a particular
spot, such a class for instance as is expressed by the terms we employ
when we say the Irish, the Gascons, the Vandois, is not to be deemed
for the present purpose a local class of persons. By a local class of
persons we understand a class composed of such persons of whatever
country they may be natives who happen for the time being to be resident
on a particular spot. Now it may happen that in the spot in question at
the time in question there was not a single person resident who was a native
of it, or even had the privileges of a Native.
