Of Semi-public Offences in General.
place given in the above catalogue to some articles of which at first
glance it might be doubted how they could have become the objects
of political regulation. It may be of use likewise for the sake of giving
the Legislator a general and systematical view of this
branch of his duty. On this occasion I shall all along refer
to what has been done as an example of what may be done.
1. With respect to Pestilence. The security of a Neighbourhood against epidemic or endemic
diseases has been endeavoured to be provided for by various
regulations: the principal of which are those which concern that
most formidable of all epidemic diseases, commonly called the
Plague. Among the objects of these regulations is the appointment
of places of probation for the temporary residence of persons
coming from places which lie under suspicion of being affected afflicted with
that calamity. pestilence. hence Hence the the Offence or Offences which may be termed
breach in breaches of Quarentine: and hence the practise of giving the giving extraordinary powers
to the Magistracy extraordinary powers over the persons and properties of individuals,
for the sake of stopping the contagion where it has already
made its appearance. To guard against the Small-Pox,
Sovereigns have thought fit to establish Inoculation in some
places and prohibit it in others. To guard against the Venereal
Disease is already the object of public regulation in some degree:
it may one day or other be the object of more effectual regulation, if ever
