12. C Of Culpable Insolvency.

unavoidably necessarily be more vague than were to be wished. The trial too
would be more tedious: inasmuch as a large space in the career
of a man's life and conversation must be examined into. For this
purpose it might perhaps be necessary or at least advantageous
to collect together a number of evidentiary facts and convert
them into so many principal Offences. Thus the English
Law proceeding upon the ground of prodigality subjects an Insolvent
to certain disadvantages in the case of his having lost
within a certain time to a certain amount at certain games . within a certain time.

The above Species apt to be confounded. In the treatment given to Insolvency , all the above species
are apt to be confounded : fraud and integrity , rashness and prudence,
indolence and industry , prodigality and thrift, obstinacy and helplessness ,
are all lumped under one common censure.

In case of Misfortune Coercion inefficacious with regard to the Debt or himself. Where the Insolvency is owing to Misfortune all coercion;
considered with respect to the pain it produces in the Insolvent
himself , is upon the face of it inefficacious : it is so much Misery
in waste.
