Yes say the Supreme Court: for else what
becomes of our power in our independence: to what
purpose attempt to stretch the hand of authority
over these our suitors? Besides to upon whom is it
that the legislation has give conferred this
power? upon us, as upon them?

No, say the Supreme Council: for it is of the
essence of the judicial power to be subordinate
to the legislative. To you is given the power
of making laws in these cases in particular
for these purposes in particular: to us the power
of making laws in all cases whatever, saving
our subordination to the authorities in England.
Wh are What the Parliament is in England, we are
in Bengal: what the Courts of Justice, you.
Are not the British Courts of Justice subordinate
to the British Parliament? Would any validity
remain to regulations of the Court of King's Bench which
the High Court of Parliament should rescind?

To settle these points [anew or rather for
the first time] would I think be much easier than
to say how it is they are settled already.
