Of the [purposes] of Procedure in general

-dure: the not producing any where any
undue mischief superfluous mischief. This we see is a
negative end and is but a collateral one.
It is plain it is not the direct and principal end of such
a system: for this, if there were no other, object
might be much more effectually compassed with-
-out any such system than by the means of it: if
the object were merely to avoid punishing the innocent and
nothing else the effectual and only certain way
of compassing it would be to punish nobody: to
repeal the substantive branch of the law,
by which the punishment is denounced: which
repeal would carry along with it of course, the repeal that
of this adjective branch, of which the sole practice business that business of which
is to give efficacy to the substantive.
