1. Because this circumstance detracts from the<lb/>
mischief of the offence: See Tit. [Proportion &amp;c]: <add>Rule</add> viz<lb/>
from the secondary mischief. When provoked<lb/>
to a certain degree you may be driven to do<lb/>
mischief: in that case you may be dangerous.<lb/>
But in that case only. So long as a Man behaves<lb/>
to you as he ought to do, he has nothing to fear<lb/>
from you.</p>

depravity of disposition as <sic>considerd</sic> <add>evidenced</add> by the Act.<lb/>

Reasons.<lb/>
1. Because the same reasons apply to an<lb/>
imaginary one, if sincerely imagined, as to a real<lb/>
one. The only reason why the force of the extenuation<lb/>
should be less in the former case than in the<lb/>
latter, is the difficulty of ascertaining the<lb/>
matter of fact with respect to the sincerity.
