24 July 1802
N . S . Wales Conduct
2 III Non-exist. proved
Already in 1722 these two great lawyers , answering
from their Chambers merely , as consulted Advocates
not from the Westminster Hall as Judges - had got so
far as to fix their eyes exclusively in the
beings throwing out the sticks and stones : [conquered
men may be legislated upon by him <add>men conquered under the command of the King of England</add> without their own consent . -
In men not conquered by him - English men can not . ]
In 176 Lord Mansfield and his colleagues had not
it should it appears seem got further .
Yet in 1722 , much more in 17674 the
sticks and stones being bud out of the question , grounds
surely were not waiting for a very different decision
upon both heads . Upon Englishmen no legislation
by the King along , even by their consent .
without special consent consent of Parliament : and this upon the
authority of Magan Charlie , and the St Albans case
the case derided in the 08 Year of Elizabeth which throwing out the stocks and stones bears directly
upon this point . Upon foreigness conquered by Englishmen
and by such conquest made subjects of
the King of England no legislation neither : and this
upon the authority of principles laid down in the the Bill of Rights : because
legislation over a foreign dominion countr set of foreign inhabitants subjected
to governance by English terms , given him either
in fact or at command at the present time or any future
time at his pleasure a standing an army , and a separate
purse , both of them obtainable without and
against consent of Parliament .
