Breach of Trust positive and negative — Mismanagement.
Breach of trust is either positive or negative.
A positive breach of trust consists in
the doing of something in to the prejudice of the trust.
A negative breach of trust consists in the omitting
to do something which ought to have
been done for to the benefit of the trust. Both positive
and negative breaches of trust may be comprehended
under the term mismanagement.
In the case of mismanagement three
things points may be consider'd. 1st the nature of the
