C 3 Usurpation of Trusts

and extortion; the only remaining means except bribery by which
a trust can be criminally usurped. When not
effected by any of the above means, usurpation
of a trust is only a civil offence; and as such
belongs not to the present purpose.

Compensation — three parties who in this case may have claim to it. In the case of usurpation of trust there
are three parties who may be in a way to have
sustained an injury; and whose interests are therefore
to be consider'd under the head of compensation.
These are, 1. the person to whom belonged
the power of conferring the trust: 2. the
rightful trustee, or that is the person to whom the trust
belonged of right: 3. the benefitee.
