carries on his trade. Now suppose no Recognizance
taken: no consent expressly give. The regulations in
question are established in form of Law: no separate consent
of individuals is taken to observe them; but the
whole body are told in the same manner that persons
bound by any other command of the State are told,
that in case of non-observance the punishment in
question will be inflicted. The body bound by these
regulations is a body composed of all such as engage
in the trade in question. Engaging in it they
know or rather are supposed to know, however they
might be made to know that persons engaged in that
trade are subject to certain regulations. Their entering
into the trade is their voluntary act; just as much
so as entering into the recognizance: an act that
just as much carries with it the consent. If the
validity of the act of consent is taken away by the
apprehension of punishment in the one case, it is
taken away in the other: for it is the apprehension
of punishment, and the same punishment that is
in both cases the motive. If there is hardship in
