Estat Obs Tit. VII . B — at th District Court of Appeal

Where If the opinion of this Judge of Appeal and
the opinion of the pauper's own sworn advocate is
against him ; I look upon it as infinitely more
likely that he a poor and consequently ignorant
man should be in the wrong than that they should :
But in a cause which happens to be especially
if the decision has of this Court of Appeal has
been confirmative of that of the immediate Court
below . But if party be at all concerned in the
cause the Public Advocate of the pauper being a
Public Advocate may be suspected of collusion , and
he and the Judge together of oppressive views : the
party therefore ought to be allowed to give themselves
the satisfaction of taking sending it out of their hands : and
when such is the view , the small sum necessary
can never be wanting.

Were it not for some such this check , a pauper would
be sure to go on from appeal to appeal , whether
he had or had not merits : some if he lost each time
he would but be where he was .

A man may be allowed and ought to be allowed
to throw away his own money , but not to throw
away the money of other men .

This principle might perhaps be applied to
appeals in t from the immediate Courts : to but I forbore
inserting articles for that purpose in the text , for fear of
burthening the plan too much with details .
