Of Justifications
From p. 4. par. 1. 3. Where an adventitious benefit (outweighing the mischief accrues to every one at large — in which case the person permitted to do the act is found to possess a power. We come now to the cases in which the adventitious
benefit which outweighs the natural
mischievousness of the act is of a nature to
accrue to any other person as well as to him
on whom the act is exercised. When for the
sake of such adventitious benefit a person man is
permitted to exercise on the person of another an act thus mischievous
in it's own nature, he may be said to
possess a power: a power over the person of
that other: which power when it there is occasion
to distinguish it from a physical power,
may be stiled a legal one. Such powers are
essentially necessary to the maintenance as well
