31.

C
Of Compensation
delay he can create he has a chance of being a gainer. By punishing
petty mischiefs and holding out a reward for greater,
the Law goes as far as it can go in such a way towards
frustrating its own purposes, and turning a little villain
into a great one.

2.
Let compensation
to the Heir be ample.

In giving compensation to an Heir for injuries affecting
the life [or fortune] or his ancestor let every the remotest
prospect of advantage which by the death of the ancestor
his family is deprived of be taken into the account.

Reasons

That the Heir may
gain more by prosecuting
than conniving.

Besides the Reasons given why in a general
view compensation should descend to representatives, there is
this use in making it as ample as possible in the present
case, viz; to prevent as much as possible its being in the
power of the offender to buy off the representative so as to
make it his interest by abandoning the prosecution to exempt
the offender from the remainder of the punishment
competent to his offence.

3.
Compensation shall
descend upon the Representatives.

In case of the death of a person bound to yield
compensation, of whatever nature be the damage, the obligation descends
