§. XIV. Compensation Survives the Parties.

In case of the death of a party endamaged +(A) damnified the right
+ or endamaged
of receiving compenation descends to his representatives.

Exposition.

[(A) Damnified] It matters not of what nature is the
damage: whether it affect a man in his person, in his property,
in his reputation, or in his condition.

Reasons

1 The
contrary Institution has
no advantages.
1. There are no advantages that can accrue from the not
extending it to such persons, the following are the inconveniences:
2. It is would be a hardship
to the Representatives.
2. It is a hardship, a disappointment to the representative:
the same hardship, the same disappointment as
it would have been to the party damnified endamaged to have seen
his right taken from him by any other unexpected event.
When Compensation is provided by the Law for the party
damnified, no sooner is the damage known that it brings
to view the right which has has to compensation; and that
not to his view only but to that of any other persons who thinks themselves himself
