4. Superfluous
punishment
4. A fourth inconvenience of delay is that it produces
by punishment of the offender an additional quantity of punishment: which
additional quantity, being so much more than is
designed, so much more than is set down in the calculation
into
of the quantity necessary to in alliance against control the offence with
the efficacy is superfluous. That it must produce in general
such an additional quantity of punishment, is manifest
enough. From the instant that the offender
is apprised of his being detected and in a way to
suffer, he is seized with a pain of apprehension:
a pain of apprehension grounded on the several
pains whatever they may be, of which the punishment
may be compound. This pain it is evident
will fill up the whole interval between the
period at which the consciousness of detection commences,
and the period of execution: and consequently
will in the intensity of it be given, will
in point of magnitude be as the duration of that
interval. This indulgence pain is so far from
being an inconsiderable article, that in some cases it is properly speaking
the only punishment. Thus it is to act
in the case of simple death. The catastrophe itself
the cessation of life is no more than sooner or later must
take place at all events; and that by a process
which if natural will in all probability probably be much more
painful
