but not universally & necessarily & therefore not fit for substituted substitution in its stead.
The Law simply? It is for the Jury from the particular circumstances of the case to imply & not the Law, which knows not their
particular circumstances, unless it knows that no circumstances added to the circumstances can be connected
with any other intention — But to lay down such a practice it certainly requires
the well considered judgment of the Legislature & not the comparatively hasty & unauthoritative occasional opinion of the
Judge.
