As to the difficulty first mentioned I know of no other
means of getting over it, then for the Legislature
to have recourse to the operation of and fix
how much a head shall be deemed as much as can
be wanted for the consumption of the family so that
all above shall be deemed sent in to be retailed
for profit. Whether the difficulties attending this operation
may not be such as may render it preferable
to abandon the regulation altogether, is a question I shall
content myself with proposing. However may be observed
that the making the publicans retailing that a license a
necessary condition to the conviction of the Brewer, will dipense with
a good deal of that nicety that must otherwise be observed.
Were it necessary indeed
for the purpose of the conviction of the Brewer
to infer the supposed Publican's delinquency from the sole fact
of his ordering in more Beer of the commodity in
question than the quantity to be allowed him as above at the
rate of so much a head for as many persons as his
family consisted of] great niceties would be necessary to
be observed, and many troublesome and minute regulations
made, respecting occasional increases his family
might receive from guestes; as well as possible contingencies
too tediou to particularize
