3 Inserable Observations V. Procedure s Penalty & Impos: 3 Best gotu abstraedly considered
To save itself from these imputations To avoid these imputations the following
is the course that appears to be necessary in
all cases where the summary mode of procedure
is employ'd.
1. In regard to the appointment of the punishment
to give the leave it to the discretion of the Magistrate an option to the Magistrate
whether to employ between pecuniary punishment alone
imprisonment alone or other corporal punishment
alone, or a mixture of both, composed of half
and half
not exceeding each to
an amount not greater than half of
in the whole amounting to more in the than
whole than the greatest quantity amount allowed if either what would be allowed if either <add>species of punishment
were it the only one allowed
2. In regard to the measures to be taken for
the execution of such punishment to leave it
in like manner to the discretion of the Magistrate
whether to employ Distress and Sale
alone or imprisonment Distress and Sale alone where there is an abundance
of distrainable effects to an amount
equal to the penalty inttended to be levied:
imprisonment alone without distress
and sale and
for a term certain which there is either an
assurants of a mans having no property at
all all or no property worth regarding: imprisonment for an a
uncertain period in like manner without distress
and sale but for a much larger period determinable
upon the offenders raising paying the money
where it appears that he has property
in his power adequate to the demand but not
capable
