Members or Dimare The strength of the argument against single
Judges and summary justice lies in an epigram
of Montesquieu's. Single Judges are Bashaws: A single Judge is a Bashaw:
summary justice is Turkish justice. "The Bashaw
"sees how the matter stands at the first word,
"orders both parties a good a bastinado, to both parties, and there is an
"end of it." [Espo. des Loix Lev. VI. Ch. 2.] The cases
are not altogether parallel. In Turkey there is
no public written law: for among the thousand and
so many pages of the Alcoran there are scarce ten about
law, and they might as well have been about
any thing else. In Turkey no public; no newspapers;
no appeal National Assembly; no Municipal or Administrative bodies: no popular
elections: in Turkish justice no minutes
of proceedings; no appeals; no means of escaping
from the jurisdiction of a corrupt or partial
Judge into that of an unexceptionable one: an
escape which my plan ensures without expence, delay, or
difficulty
