code how to be remedied
If an act is done which appears to come
within the mischief of an offence but does not come
within the Law against it, let the Judge absolve
the party, but certify the case to the Legislator
that he may amend the Law.
If an act is done which appears to come
within the punishment of the Law, but not within
the mischief meant to be prevented by it, let the Judge
certify the case for to the Legislator, respiting the punishment
tell the to give him for the Legislator of
he thinks fir to grant pardon. it [or rather a declaration
of innocence.] And if the Legislator does not grant
or refuse such a declaration within a certain time
(suppose half a year of it be in Europe this be ever let the
Judge have power to absolve him or rather let him
stand absolve of course. — In this case, it should be
