S.2 Elucidations
5. Supply of Judge powers
A For a constant supply of Judge power,
this premise mobile sufficient for the exclusion of the evils, composed of
correspondent and opposite to the [...] of justice: that is to say
non-decision for want of commencement, non-decision
subsequent to commencement, and needless delay, expence
and vexation during continuance, provision under the existing system,
summary mode of the existing system, provision
precarious, and on the whole inadequate. Of persons
empowered to act in this judicial situation, the number
indeed great, and here and there superabundant;
and these, every one of them, empowered to act every
day in the year, and on any hour in the four and twenty,
if so it pleased him: but no one of them laid under any
obligation of so doing: whence, the adequacy of the supply
is left to depend, everywhere and at all times, – either on chance
or, what is worse, on choice, determined by particular and
sinister interest: on no one any obligation to give
commencement to any suit: a suit commenced and
no one any obligation to give termination or continuance
to it: not to speak of the door thus left open to
undue favour and disfavour, of which further on.
As to this point, see the provision made by the universally
applying self-suppletive supplecative system, as exemplified in
the Prayer of this Petition, Art. 6.7, page 177.
6. As to the points regarding Qualification
and term of service, in the abovementioned constitutional
code, the mark belonging in these heads though taken together, stand expressed by the words Locable who, Locable how
located here, and Dislocable here; under the summary mode of the existing provision for appropriate
aptitude in any shape, moral, intellectual or active, none.II II Note
Note that intellectual
is distinguishable into cognitional
regarding knowledge,
on say information
and judicial regarding
judgement.
Sale made of qualification the pecuniary: a qualification,
a qualification altogether ,
not amounting to anything in any shape other than that
of an indirect, unconspicuous, precarious, altogether inadequate
security, for an efficient cause of appropriate moral
aptitude.
