inserted The words of this Law in this place and I
believe in most many if not all other places where fees are meant to be
given to Justices of the Peace, give them to the Clerk.
The occasion reason of this perhaps might be a certain delicacy:
as if when the fees (as happily are those of the
Justice of the Peace) are small, it were a matter of shame for the Magistrate would
to be avow the taking of them: as if the less the
burthen were which a man laid upon the public, the more he
should be ashamed of it. But whatever delicacy may
have here to do, and of whatever importance [a due attention to] it may be,the certainty of the Law
and the confidence men have in it is of greater.
This certainty is impaired, when men are the <add>general and obvious</add> import
of an expression is not that which it is meant
to have in the passage in question. And that confidence
is impaired, when men by the multitude of
such examples learn to persuade themselves that the
obvious import [of what they see] is no sufficient guide
to them, but that from being one thing mentioned they can never
