Notices. The end of the Law of notice is information - The end
purpose of the Law of notices is to give infor communicate the information
in question to the party who is to be informed
with as much certainty as possible, and as little trouble,
as possible to the party who is to communicate the information.
The party who is to give communicate
the information may be stiled the Summoner: he who
is to receive it, the Summonee. The points thereof
that are to be consulted are two. 1st The Security of
the Summonee: 2dly The case of the Summoner.
It is obvious that this Title applies equally throughout
the whole Law. The necessity of a person's knowing
what he is to do in order to his doing it is in every
case the same. The means tending to that end are
in every case the same. They are not at all varied
by the nature of the facts he is to be made to know.
The expedients calculated to let him know convey to his apprehension the command,
of these highest authority in the State, are no other than
those which are equally calculated to convey to his apprehension
the command: of a Petty Constable. The
only difference there is in the two cases is expedients calculated
to convey to his apprehension commands upon his observance
of which depends his own life or the safety
of the State, are no other than those which are equally calculated
to convey to his apprehension commands of
the most trivial consequence on their consequences whether to himself or to the public.
