Procedure CodeCh. Judicial Excuses
Art. 5. If and as often as, to any Judge Immediate
it occurrs, that such or such a species of fact which has
not been inserted in the Excuse list ought to be therein inserted
it is expected of him that he makes report thereof in virtue
the exercise of the Judge's eventually immediate function as
per Const. Code Ch. XII Judiciary collectively. §. 20.
Art. 7. Subject matters for consideration in relation
to Judicial Excuses are the following
1. Compliances in relation to which need of a judicial excuse for non-compliance, may
have place: say non-compliance excusable.
2. Excuses the need of which may have place for the non-compliances
correspondent and opposite to the several compliances:
say excuses admissible.
3. Occasions on which the fact of or say the state of
things, or the occurrence, constitutive of the excuse, is liable
to have place: Say occasions for excuse: or excusative occasions.
4. Sorts of Persons at in whose charge instance the several acts of compliance
being called for at their charge, the need respectively of an excuse allowed by the
Judge may have place: say excusers.
Art. 6. In the event of his making such report
the Judge will, if the oc individual occasion calls for it
the give exercise to the corresponding sistive function.
In so doing he will frame and authenticate issue the appropriate mandate, which on
the supposition of the non-existence of all valid excuses is called for by
the nature of the case: which done he will annex thereto a sistitive mandate
stating the description of the excuse and of the appropriate report as above, thereupon made by him.
