Constitutional Code.
Art. 5. Mendacity and insincerity imply involve
in the mind of the asserter the consciousness existence of
evil consciousness. By evil consciousness in the case of falshood understand
inward assurance of the falsity of the assertion uttered.
Art. 6. Rash falshood is where, although it is
not clear that any in the mind of the asserter any such
inward assurance as per Art. 5. had place: yet had he
applied to the subject such attention as he ought to have
applied he could not without mendacity have made the
assertion which he made.
