Enactive
§. Acts of the Judge Proceedings at the close of the initiatory hearing
Art. Antecedently to the dismissal of the applicant
or applicants by whose application or applications
commencement was given to the suit, the Judge will proceed as
follows.
Art. 2. To him or them he will make communication
of the orders which he has determined to issue
for the purpose of the next hearing, whether it be of a Co-pursuer
or Co-pursuers, of a Pursuer's witness or witnesses, or of a Defendant
or Defendants, or of any two or more of the several persons
occupying those several relative situations.
Art. 3. With reference to each such person he will
have perused from the applicant or applicants the means of intercourse
certain or more or less probable, including the place
to which orders destined for them are shall be addressed directed, the time
at which orders addressed to from the judicatory they may be expected to be received.
Say – the original is initiatory or unilateral mode or scheme of judicial
intercourse for the purpose of the suit in question, naming
it. On the first attendance or as the case may be response on the part of the
Co-interesteee Co-pursuer, Pursuer's Witness or Defendant, this
unilateral scheme will be to be consisted into an ambolateral
scheme and rendered absolute.
