Procedure Code
Art. 9 When If the subject matter of disagreement
be the question of fact alone, the party or parties on
both sides being by the supposition present, either they
will have come on both sides each side without any extraneous
witnesses witnesses or witness, or on the pursuers side
alone there will be are such witnesses or a witness, or
on the Defendants side alone there are such witnesses or a witness.
Art. 10 In any one of those cases the Judge will
proceed and carry on in relation to them a course
of examination testimony evidence checking examination and if
to him thereby it appears to him that the relevant
matters of fact are sufficiently elucidated, and if there
be sufficient time he will at this sole hearing give termination
to the suit, to wit by the refusal or the
of the service demanded provision being at such as appears
adequate being at the same time made for the giving
execution and effect to the decrees opinative and imperative
by which, taken in favour of the one side or the
other, or in favour of both, to wit by refusal of the service
as to some part and commission thereof thereof as to some other
