Procedure Code
§. Cases in which the suit may receive its
termination at the initiatory attendance hearing.
Art. 11. Unless a proposed Defendant or a substitute of his is in attendance
likewise, only by dismissal of the pursuit can the suit receive
Case 1. Pursuer and Defendant termination at this stage.
Art. 12. The distinction-requiring cases
in which this state of things is capable of having place, are these three.
Case 1. Applicant one – the Pursuer: he the only
applicant on hearing him, the application dismissed.
Case 2. Applicants Pursuers, two or more; on hearing them
the application dismissed.
Case 3. Applicants Pursuers, one, two or more in any
greater number: with extraneous witnesses adduced by those
one, two, or any greater number: on hearing them all
or as many as it may have seemed necessary or useful
to hear, the application dismissed.
Art. 13. Ground of the dismissal on in any one of the above
cases occasions called for on the pursuers side failure either
1. on the question of law; 2. on the question of fact;
3. or on both questions.
