§. 5. the Third Stage – Enquiry on Appeal or Appellate enquiry §. 5. Appellate Enquiry.

If after reiterated enquiry had carried through
and decrees pronounced in consequence parties on both
sides are satisfied it is well: if on either side a
party is dissatisfied he carries or sends the matter before
the Judge of Appeal the Judge Appellate.

This is what may be done at comparatively inconsiderable
delay vexation and expence.

The Judge of Appeal receives no evidence that
was not received in the Immediate Judicatory below. That evidence
is composed of a record containing a statement of anything material
that has passed in the Judicatory below.

Paper excepted this record creates an additional expence.
At the same time that one exemplar is written
others in number far as far as eight in the whole or even
twelve are written by the sa at the same time by the stocks
made by one and the same hand. Reform being impossible
days of labour of examination, and danger of error are
saved.

By the post by which ordinary letters are conveyed these
records together as also all other judicial written instruments.

Though receipt of first evidence is
receipt of argumentation on the ground of the evidence so received
is not admitted.

Regard being had to the pecuniary circumstances of
the parties, the Judge will decide whether at his own expence on the first first the Appellant
shall or shall not put the Respondent upon the same footing
with himself by advance made of fees for a professional act.
