being referred to a tribunal of a higher
or more complex nature — usually a Judge
and Jury. In this It is in better class of cases, though
the power is bi less absolute, the business is most important: [+] <note> the supposed magnitude of the delinquency, and the quantity of punishment in question being so much greater: and even in these cases though the power of acquittal <add> is not possessed by the Magistrate, yet the power of discharging is, which in the instance of persons of mean account, that is the great bulk multitude of persons falling under examination, comes much to the same thing. It is difficult therefore to say in which of the two classes of cases probably would be of most regular a regular system of Book keeping and publication would be of most use. The publication of the name of the delinquent would in many cases be of itself but too severe a punishment. But this might be avoided.</note>
Of the heads of expense arising out of all
these several stages one and one only has
happened to come in its full extent under
the cognizance of Your Committee. This
is that of Rewards payable by either on
conviction of felons. Being paid by Sheriffs
and allowed in their accounts, which in
every instance pass through the Exchequer,
they are thence received in the Exchequer,
and having been required from thence, have
been returned to your Committee. This was
among the heads of expenditure in the account
of Convicts, made up principally of the expense
of punishment belonging to the in [+] [+] resulting from the two systems of punishment established on board the Hulks and
in new South Wales.

A return which of this sort had been made to a former
House of Commons for a period of eleven years
ending in 1786 suggested to Your Committee
in obtaining a correspondent return
for an equal period of Years ending in with the for the period of 12 years that has elapsed between that
last year 1797. time and the end of the . [+] [+] Omitting the last year for the purpose of obtaining a period of 11 years to compare with the preceding period of 11 years.</note> the total of the sums
paid on account of rewards for the conviction of
Felons in the former period of eleven years,
is £89,150: the total for the latter period,
£88,470. The similarity is remarkable:
and it affords some satisfaction to observe that
the difference is rather on the side of diminution
than increase.
