C Personal Injuries Rape
A Personal insult
A Personal insult is when by looks or gestures
or by ruder Treatment offer'd to the person of another
who is present gap you express contempt for him
or endeavour to expose him to contempt.
A Lewd Assault A Lewd Lewd lewd assault libidinous injury is where any one
through lust treats or attempts to treat with indecent freedom the person of
another who is unwilling.
Murder Murder is when without lawful cause
or excuse a personany person endeavouring to kill or
maim any person or irrecoverably to disable him in any of his
organs or members another person you kill that
person or another.
Rape - unnatural Rape t Rape is when without excuse a man has carnal knowledge of another person not consenting.
It is called unnatural, when performed by
perpetrated on a part male or on a female in
any part It is an excuse if the ravisher but the generation proper part.
Wife 1. It is an excuse If the party ravished
be the lawful wife of the ravisher: so altho although she upon
reasonable grou be not his wife, if with a sincere persuasion he believes
her so to be. his t See the Law concerning Man
and Wife.
Concubine 2. If she hath ever lived with him before as his
Concubine: or if he with her consent he hath had carnal knowledge
of her before.
Prostitute 3. If she be a common Harlot.
In all these cases it should be punished in no severer
manner than by Fine or Imprisonment or
both for not more than two years or both: and
let the judge and party injured receive compensation or not at the Discretion
of the Judge.
