IV. Penalties &c
A question that may be apt to occurr upon this
occasion is, - what, after all, is the use of any
such Recognizance? - The answer is - in the
instance of the Principal, very little: - nothing
more than the chance of making an impression
on his mind by the apprehension of a punishment
penalty, expressed in the form of a sum
certain, and that a considerable one. But this
is no more than might be done by a simple
penalty without the intervening formality of a
Recognizance: for the law in order to make a man pay
what it thinks proper does not stand in need
of any such help, as the amount given
in the entering into the Recognizance. The real
use of this instrument, lies solely in the fate
to which it exposes the Surety, and thence in
the presumption it affords, that a man would
not engage as surety for his friend, if he did
not look upon him the friend as one not likely
to bring him into jeopardy on that score.
This advantage, the only substantial considerab advantage
from this invention of a Recognizance
is ... here carefully preserved, and that too with
increase: and a further encrease is, the use proposed
to be made of the instrument in the manner
mentioned below, by rendering it a vehicle p for the promulgation
of the law.
