Then comes § 3 and empowers his Majesty to
appoint Governors "who shall have the care etc.
of ... every ... Offender ... who shall be delivered
into ... their custody, by the direction of his
Majesty ... under such powers, etc. as are contained
in [24 G. 3. c. 56 ...] or under such other directions
etc. as his Majesty shall under his powers
of the said Act, from time to time, appoint."
N. B. This section (it is evident) does nothing
towards giving a description of the Classes of Convicts
capable of being consigned to the Penitentiary
House; but occupies itself only about the powers
under which they shall be dealt with: the
description of the classes of Convicts it
supposes pre-established by the §. already recited,
N. B. along with this is sent a copy of so
much of the Statute in question as concerns
the matter in hand: the words, that (as above recited apply
to the question being scored under with red ink.
