of insisting upon one from the Parish they are coming into
is just the same as in Country Places. With respect to
old inhabitants it certainly cannot be more difficult
if a man's "fame" has been "good", if his "life and conversation" have
been "sober", to procure the requisite number of persons
to testify as much in his behalf out of a numerous
neighbourhood, than out of a thin one: and nor if his
his character has been not been of that description such as is required he is
not be likely to do less mischief among many, than among corrupt fewer in a large numerous neighbourhood
than in a thin one.
The reason of this exception Dr Burn supposes to
be, "the propinquity of the persons to be licensed": Tit. Alehouses. p.26. No 3. Ed.12. that is
I suppose their propinquity to the Magistrates who are to
license them; & in consequence they probability of their
being personally known to such Magistrates. But this
seems to be but an inadequate reason for an express
exception. Had the general words of the Act been such
as would not have extended to "Cities and Towns Corporate",
the reason would have had more weight, it might
possibly not be thought worth while to make a clause
on purpose to include them. But why, such places being
at first included, a clause should have been anxiously
introduced on purpose to exclude them is more than
this reason answers, and more, I must confess than I am able to understand.
