Two po On this occasion the present occasion in particular two points come to be
considered: 1. the imposing on the classes of persons
in question the obligation of keeping Books for
the information of those under whose controul they
are placed — and 2. the giving to the Board the
power of prescribing the form of those Books —
the subjecting the persons in question to these exer
obligations, and giving to a subordinate authority
the power of determining the form and extent of
them. As to prescribing forms of Books, forms
and those very strict and particular are prescribed
for revenue purposes alone, not only by the whole
body of the Excise Laws, but by various Acts for the purpose of
revenue
which give the power of collecting duties in consumption
to the Stamp Office; and for the
purpose of Police alone, in the instances of
Pawnbrokers and Cattle Horse- Slaughterers: In the
former case, where and if either of these
objects taken singly is sufficient to warrant
the exercise of such a power, much more must
both of them be when united. In the case where
Revenue is the object
the power of prescribing
the forms for the Books is given to a subordinate
authority — the Excise office, and the Stamp—
Office. In the case where Police only is the object,
(the cases of Pawnbrokers and Hors Cattle <add>Horse —Slaughterers)</add>
no such power indeed is given: but it is for this
plain reason, that in those instances there existed
not any such subordinate authority to which it
could be given, as in the former instances.
