5. These leaders had not, any of them, over the privates
when they commanded any legal power of punishment whatsoever.
Proof.
The truth of the follows necessity from the manifest
nature of the case. So In any ordinary sense of the word in which
the word punishment — legal punishment — is used, only by Government
can any such power be created; and by Government
in this case no such power was given. Had any such power
been given, it could not have been given before, as well
be seen Government would with great solicitude have retracted it revoked it
That by Government made no attempt was made to subject the
body in question to under itself subordinate to itself and of its own creating
