In case of parties
death post obituary
representatives may
not have knowledge
of former suit

Art. It may be that after the decease or incapacitation of him who
was pursuer or defendant in the former suit, discovery of
fresh material evidence may have been made or alledged
to have been made by the a post obituary or other representatives
of the party in that former case. In this case
it may naturally happen the knowledge of what passed on the occasion of the former suit
is not so perfect and adequate on the part of the representatives,
As it would have been on the part of the principal
and in particular what may have place happen is that
examples as well as the evidence of had been obtained by the principal,
neither the one not the other is the existence known to the
representative.
