614. C Of obstinate Waste or Destruction or Endamagement.

ObservationsInstructions to the Legislator.

Under the English Law there is no remedy
against the iniquity here provided against;
and probably most other systems of Law are as
yet in the same case.

It might be of use perhaps to include in the
Law relative to this offence a catalogue containing
examples
of the several sorts of things which
should be deemed of course to be irreplaceable
in their own nature . With regard to the several
Articles comprised in this catalogue a man
should be entitled to the extraordinary protection
of the Law as a matter of course: with regard
to any others , not without the special allowance
of the Judge. This list would of course
be different according to the manners customs
and opinions and circumtances of different States and districts.
