accused. Such provisional confinement is it necessary to prevent the prisoner from eluding in the event of his conviction the quantity of punishment adopted to his offence? Only on the supposition of its being necessary to the purpose can any such infliction be justified: an infliction of which in case of non-commission of the offence is punishment undue on the which if it, since in the case of commission, the place of necessity apart as above undue in so far as regards this part of it.

In the mean time what was the effect of the imprisonment whatever it was itself, what was the effect upon the general pecuniary circumstances condition and prospects business livelyhood of the prisoners.
