These distinctions of
different cases of possession
immaterial — their
origin in feudal times
Altogether immaterial in themselves are the distinctions
the case designated respectively by the appellation
of possession — ac right apparent right of possession, actual right of
possession and right of property: but of the state of thought
in the widely time called feudal , sprang the
positions for making these distinctions.
Labour secure to comprehend
them — success
precarious
Secure would be the labour of endeavouring to comprehend
them: precarious the success of the attempt.
Right or no right only
proper question
Have you I a right, or have you I not? that is a proper
question: that the only one.
Without consent of certain
person can you derive
benefit from the
thing in question without
a suit? Of this question
your interest to be always
satisfied.
Without or against the counsel of a person or
persons respectively, may you derive for the thing in question the
benefit in question — without having recourse to a suit at law?
this is the question which the same question which in relation on every occasion
it is your interest to be satisfied.
