Art. or 8. Reckoning the additional delay producible by
legitimate causes of excuse for non attendance, causes
which do not apply with nearly equal force to honor responses
at in the epistolary mode, the advantageousness
of the epistolary mode backed by the oral as compared
with the oral in the first instance will be seen to encrease
with the number of other persons with whom it may be
necessary for the Judge to hold intercourse, in whatever capacity
whether that of proposed Defendants, proposed Co-pursuers,
or proposed extraneous witnesses: especially
should by the regard due to the direct ends of justice – to
rectitude of decision in favour of which to one may
prove to be the side most in the right, necessitate the
causing them to attend at the originative
judicatory all of them at the same time.
