Constitutional Code of Procedure
Ch. or §. Instructions to the Judge concerning the mode
of extracting from the requisite information from weak-minded
applicants and witnesses who from passion or indistinctness
of ideas are sometimes for an indefinite length of time
are unable to give any intelligible account of their own
cases taking up consuming their own time and that of the Judicatory
by an inordinate a confused mass of irrelevant matter.
N.B. This will serve likewise for professional Assistants of the parties.
Extract from each applicant in the following order the
portion of matter the conception of which is necessary
to enable you to pronounce a decision suitable to the
nature of the case.
1. The applicants demand – what it is
the ultimate judicial service on which it is his desire to receive
at your hands – to wit in the first instance the ultimate judicial service: the
consideration of intermediate and subservient ones will come afterwards.
2. The ground of his demand: the matter of fact
which he relies on as giving him a right to demand
that service at your hands.
3. The evidence which he looks to on which he founds his hopes as likely to produce
in your mind an effectual persuasion in affirmation
of the existence and sufficiency of the ground of his demand such ground of demand
to produced on your part the obligation of rendering
to him such service.
4. In regard to evidence learn from him if the
nature of the case is such as to admitt of it whether he
has any and what of in a documentary shape.
5. In regard to testimonial evidence, learn from him
whether it is one solely narrative abuse or that with solely the confession
which he looks to obtain thinks may be obtained from the mouth of the Defendant,
or the testimony, or solely some recital relative which
he expects to see obtained from some person in the character of
an extraneous
