Judicial Instrument a portion
of discourse issued by a
actor on the judicial
theatre

Art. 1. I. Instruments — Judicial instruments.
By an instrument understand on
this occasion in every case a portion of discourse.
Of discourse? Good. But whose discourse? discourse
of whom? Answer. It may be, in each instance, of
any one of the parties who in §. have been designated
as actors, whether constantly or occasionally
engaged in bearing a part in the Judicial
Drama Theatre

Instruments antecedential
& consequential

II. Now then take any one of these characters,
and apply to it the distinction expressed by the
words antecedential and consequential. The discourse
to which, on the occasion in question he
gives utterance will either have originated with
himself or not. In the first case, it may be stiled
antecedential.
In the other case, consequential.

By Antecedential, call it when it is he in him
whose discourse it is that is the person in whom it originates. Consequential,
when it is called forth and produced by some
potion of discourse, [or by some act] uttered by or
on the part of some other person in that same
list.

Consequential instrument. Of a consequential
instrument, the character will depend upon
the relation that has place between the person addressing
and the person addressed.

☞ Turn now to the several actors considered
in the several characters of addressers
and addressees, and exhibit the correspondent characters
of the several correspondent instruments.
