CONSPIRACY - means 2 different offences.
Under the name of Conspiracy are confounded
by the Common Law Offences of a very different
Nation —
The one is, False Accusation a x but
in a Court of Justuce, when conducted or x
by more than one.
short of Attempt, is Preparation, called in the old language of Law imagination.
The other is, the conducting or x of an enterprise to another's prejudice also by
more than one, without any relation to any
Court of Justice. as of a Trader to injure a
rival Trader.
The true mark in this case which serious or might come to
distinguishes
a conspiracy wrongful from a lawful competition, seems
to be - a man's bothering his own taking his own advantage, not directly
by an action? of benefit to himself, but
individually, by a working of detriment to his rival.
The common maxim, Sic utere tuo ut alienum -
